Terms of Service

NOS is a multi-purpose Discord bot providing welcome messages, leaderboards, starboard highlights, lootable item drops, multiplayer fishing sessions, mini-games, and fun slash commands — all manageable from a clean web dashboard.

You must meet Discord's minimum age requirements (13 years or older, depending on your jurisdiction) and comply with Discord's own Terms of Service to use NOS.

NOS is designed for community engagement and fun. By using NOS, you agree to use every feature only for its intended purpose and in compliance with Discord's Terms of Service, Community Guidelines, and all applicable laws.

We reserve the right to restrict, suspend, or permanently ban any user, server, or administrator from using NOS — without notice and without refund — if their use violates these Terms or if we determine, at our sole discretion, that their conduct is abusive, harmful, or inconsistent with NOS's intended purpose.

This list is not exhaustive. We may, at our sole discretion, classify any use not listed here as prohibited if we determine it to be abusive, harmful, or inconsistent with the intended purpose of NOS.

Server administrators who add NOS are solely responsible for how the bot is used inside their server, including:

• Configuring the bot appropriately for their community and moderating any content generated by or through it.
• Informing server members that NOS collects certain data (see our Privacy Policy) and obtaining any consent required by applicable law.
• Ensuring the bot is not used in a way that violates Discord's Terms of Service, these Terms, or any applicable law.
• Promptly removing or reconfiguring NOS if it is being used to harm or harass server members.

NOS features virtual items (lootables, fishing catches, collectibles) that have no real-world monetary value. Virtual items cannot be exchanged, traded, or redeemed for real money, goods, or services.

We reserve the right to modify, rebalance, reset, or permanently remove virtual items, drop rates, rarity weights, or any economy mechanics at any time without compensation or prior notice.

NOS offers an optional paid subscription ("Premium") at €1.99/month. Payments are processed by Stripe, Inc. By subscribing, you agree to the following:

• Billing. Subscriptions are billed on a recurring monthly basis and will automatically renew at the end of each billing period at the then-current price, unless cancelled beforehand.
• Pricing changes. We may change subscription prices or tier contents at any time. Price changes for existing subscribers will take effect on the next renewal, and we will make reasonable efforts to notify you in advance.
• Cancellation. You may cancel your subscription at any time from the billing portal or dashboard. Upon cancellation, your subscription remains active until the end of the current billing period, after which access to Premium features ends automatically.
• Refunds. All payments are non-refundable except where required by applicable consumer protection law. We do not provide refunds, credits, or compensation for partial billing periods, feature changes, feature removals, outages, or voluntary cancellation.
• Feature changes. Premium features may be added, modified, rebalanced, renamed, or removed at any time. Paying for a subscription does not guarantee any specific feature will remain available for the full duration of your subscription.
• Chargebacks & payment failures. Chargebacks, disputed payments, or repeated payment failures may result in immediate suspension or termination of your subscription and access to the bot, without refund, at our sole discretion.
• No resale. Subscriptions are non-transferable and may not be resold or shared between unrelated servers.
• Taxes. Subscription prices may be exclusive of applicable taxes. Where we are required to collect taxes, they will be added at checkout.

For consumers in the EU/EEA with a statutory right of withdrawal: by activating a subscription and beginning to use paid features immediately upon purchase, you expressly request immediate performance of the contract and acknowledge that you lose any applicable right of withdrawal once the service has been fully performed. Where withdrawal rights cannot be waived, they continue to apply.

NOS is provided on an "as available" basis. We reserve the right, at our sole discretion and without prior notice, to:

• Add, modify, remove, rename, merge, split, replace, disable, or permanently discontinue any feature, command, tier benefit, pricing, virtual item, drop rate, or any other aspect of the bot or dashboard.
• Perform scheduled or emergency maintenance, updates, or migrations that may temporarily affect bot availability or stored data.
• Sunset, wipe, rebalance, or archive any virtual economy, item collection, or progression data, at any time and without compensation.
• Apply rate limits, anti-abuse measures, or throttling to any feature or user.

We do not guarantee uninterrupted, error-free, or unchanged service. No feature or virtual asset is promised to remain permanently available. Continued use of NOS after any modification constitutes your acceptance of the change.

Some features are marked as beta or experimental. These features are provided as-is, may change significantly or be removed at any time, and are not covered by any service-level guarantee. By opting into beta features, you accept that they may be unstable and that we are not liable for any consequences or data loss they may cause.

NOS is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by applicable law:

• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use NOS.
• We are not responsible for data loss, server disruptions, or any harm caused by bot misconfiguration.
• We are not liable for actions taken by server administrators using the bot's features.
• Our total liability to you for any claims shall not exceed the amount you have paid us (if any) in the twelve months preceding the claim.
• We do not warrant that the bot will be error-free, secure, or available at all times.

We reserve the right, at our sole discretion and without prior notice, to:

• Remove NOS from, or restrict its features within, any server.
• Ban or throttle any user, server, or administrator found to be violating these Terms.
• Delete data, reset virtual item inventories, or roll back actions associated with abuse or exploits.
• Suspend or terminate paid subscriptions for serious or repeated violations, without refund.
• Report illegal activity to Discord, law enforcement, or other appropriate authorities.

You may stop using NOS at any time by removing it from your server. Termination does not relieve you of any obligations accrued before the termination.

You agree to indemnify, defend, and hold harmless NOS and its developer, operator, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the bot, your violation of these Terms, or your violation of any third-party rights.

We are not liable for any failure, delay, or interruption of the service caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, government action, cyberattacks (including DDoS), ISP or hosting provider outages, Discord API outages, Stripe outages, or any other third-party infrastructure disruption.

Upon request, we will provide you with a copy of your personal data that we store (as described in our Privacy Policy) within a reasonable timeframe. You may also request deletion of your data at any time. Once deleted, data cannot be recovered. Active subscriptions are not automatically cancelled by a data deletion request — you must cancel the subscription separately via the billing portal.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if necessary, before the competent courts in Germany.

If you are a consumer in the EU, the mandatory consumer protection laws of your country of residence continue to apply regardless of this clause.

We may update these Terms of Service at any time. Continued use of NOS after changes constitutes acceptance of the revised Terms. Significant changes will be announced on our Discord support server.
